Motlanalo Audit Firm CRM Portal – Terms and Conditions

Welcome to the Motlanalo CRM Portal (the “Portal”), operated by Motlanalo Audit Firm (Pty) Ltd (“Motlanalo”, “we”, “our”, “us”). By accessing or using the Portal, you (“Client”, “you”, or “your”) agree to comply with and be bound by these Terms and Conditions (“Terms”). Please read them carefully before using the Portal.


1. Purpose of the Portal

The Portal provides registered clients with a secure digital environment to:

  • Upload and download requested documentation (including RFIs – Requests for Information);

  • Open, manage, and track support tickets and audit queries;

  • Monitor project progress and deliverables;

  • View and manage invoices and payments.


2. Access and User Accounts

  • Access to the Portal is limited to authorized clients of Motlanalo Audit Firm.

  • You are responsible for maintaining the confidentiality of your login credentials and must not share them with any unauthorized third party.

  • Motlanalo reserves the right to suspend or terminate your access if unauthorized use or security breaches are detected.


3. Client Responsibilities

By using the Portal, you agree to:

  • Upload only accurate, complete, and relevant documents as requested;

  • Ensure that uploaded materials are free of malware or harmful content;

  • Use the Portal strictly for business purposes related to Motlanalo’s professional services;

  • Avoid any activities that could compromise the integrity, performance, or security of the Portal.


4. Data Security and Confidentiality

  • All data transmitted through the Portal is encrypted and stored securely in compliance with POPIA (Protection of Personal Information Act, 2013) and other applicable data protection laws.

  • Motlanalo implements industry-standard security measures to protect client data, but we cannot guarantee absolute security against all potential threats.

  • Clients must notify Motlanalo immediately of any suspected unauthorized access or data breach.


5. Document Management

  • Uploaded documents remain the property of the client but are made available to Motlanalo for professional use in providing audit, assurance, tax, and advisory services.

  • Motlanalo reserves the right to retain copies of submitted documents in accordance with statutory recordkeeping requirements.

  • The Portal is not intended as a permanent data storage system. Clients should maintain their own backups of all submitted materials.


6. Support Tickets and Communication

  • All client support requests, project updates, and technical issues must be logged through the Portal’s support system.

  • Responses will be provided within Motlanalo’s standard service-level timelines.

  • Communications within the Portal are considered official correspondence for engagement purposes.


7. Invoices and Payments

  • Clients may view and download invoices through the Portal.

  • Payment terms are defined in the client engagement letter or service agreement.

  • Any discrepancies in invoices should be reported within seven (7) business days of receipt.


8. Intellectual Property

  • All content, software, and materials on the Portal are the property of Motlanalo Audit Firm or its licensors.

  • You may not copy, distribute, modify, or create derivative works based on Portal materials without written permission.


9. Limitation of Liability

  • Motlanalo is not liable for any indirect, incidental, or consequential damages arising from Portal use, including data loss, access interruptions, or system failures.

  • The Portal is provided on an “as is” and “as available” basis without warranties of any kind, express or implied.


10. Termination of Access

  • Motlanalo may suspend or revoke access at any time due to inactivity, breach of these Terms, or completion of professional engagements.

  • Upon termination, all Portal access rights will cease, but Motlanalo may retain necessary data for regulatory and compliance purposes.


11. Amendments to Terms

Motlanalo reserves the right to update or modify these Terms at any time. Updates will be posted on the Portal, and continued use after such changes constitutes acceptance of the revised Terms.


12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa, and any disputes shall be resolved in the courts of competent jurisdiction in Gauteng.
